1. About These Terms

These Terms and Conditions ("Terms") govern your access to and use of the website located at the-foundry.com.au, and all associated services, memberships, and platforms operated by Foundry Partners Pty Ltd (ABN 57 690 331 821), trading as The Foundry, including Beauty Hub by The Foundry (collectively, "we," "us," or "our").

By accessing our website, booking a discovery call, purchasing a membership, or using Beauty Hub, you agree to be bound by these Terms. If you do not agree, please do not use our services.

These Terms are governed by the laws of New South Wales, Australia, and you submit to the exclusive jurisdiction of the courts of New South Wales.

2. Who We Are

The Foundry is Australia's beauty and skin clinic growth and marketing partner, providing strategic, marketing, and operational support to salons, clinics, and aesthetic businesses across Australia.

Beauty Hub by The Foundry is a subscription-based platform and mobile application designed specifically for salon owners, clinic managers, dermal therapists, and aesthetics professionals. It provides access to strategy calls, live workshops, templates, community forums, industry insights, and brand partner perks.

3. Eligibility

Our services are intended for business owners, clinic managers, and industry professionals operating in the beauty, aesthetics, and wellness sector. By using our services, you confirm that:

  • You are at least 18 years of age;
  • You are using our services for business or professional purposes; and
  • You have the authority to enter into a binding agreement on behalf of yourself or your business.

4. Memberships and Subscriptions

4.1 The Foundry Memberships

The Foundry offers the following membership tiers:

  • Beauty Hub — a monthly subscription platform for beauty business owners and professionals.
  • Marketing Partner — a done-for-you marketing service for salons, clinics, and aesthetic businesses.
  • Bespoke Partner — a fully tailored, embedded growth partnership.

Specific inclusions, pricing, and deliverables for each membership are outlined on our Memberships & Pricing page at the-foundry.com.au/pages/our-memberships. These details may be updated from time to time, and we will notify active members of any material changes.

4.2 Beauty Hub Membership

Your Beauty Hub membership provides access to the platform and all included features from the date your subscription commences. Membership is offered on a month-to-month basis. Key terms include:

  • No lock-in contracts. You may cancel at any time.
  • Billing. Membership fees are billed monthly in advance. Additional seats (Manager Add-On) are billed at the applicable monthly rate.
  • Launch Pricing. Promotional or launch pricing (e.g. first month at $199) is applicable to the period specified at the time of sign-up and is subject to change without notice.
  • GST. All prices are exclusive of GST unless otherwise stated. GST will be added at checkout where applicable.

4.3 Manager Add-On

Additional manager seats may be added to a Beauty Hub membership at $49 per month per additional seat. Manager seats provide access to manager-specific content, tailored workshops, community access, and the full resource library.

5. Payment

By providing payment details, you authorise us (or our third-party payment processor) to charge your nominated payment method for the applicable membership fees on a recurring monthly basis until you cancel.

If a payment fails, we reserve the right to suspend or restrict access to your account until payment is received. We will notify you of any failed payment and provide a reasonable opportunity to update your payment details.

6. Cancellation and Refunds

6.1 Cancellation

You may cancel your membership at any time by contacting us at hello@the-foundry.com.au or through the account settings in the Beauty Hub platform. Cancellation will take effect at the end of your current billing period. You will continue to have access to your membership until the end of that period.

6.2 Refunds

We do not offer refunds for partially used billing periods. If you believe you have been charged in error, please contact us within 14 days of the charge at hello@the-foundry.com.au and we will review your request.

We reserve the right to offer refunds at our discretion in exceptional circumstances.

7. Discovery Calls and Strategy Sessions

Discovery calls and strategy sessions (including 1:1 strategy calls included in Beauty Hub) are offered to help you understand our services and explore how we can support your business. These sessions are:

  • Non-binding in nature;
  • Intended as a consultation, not professional advice; and
  • Subject to availability and scheduling via our booking platform (Calendly).

We reserve the right to cancel or reschedule sessions with reasonable notice.

8. Digital Content, Templates and Resources

As part of your membership, you may receive access to templates, guides, marketing assets, trend reports, and other digital resources ("Resources"). These Resources are provided for your personal business use only.

You must not:

  • Share, resell, sublicense, or distribute Resources to third parties;
  • Use Resources to develop competing products or services; or
  • Remove or alter any intellectual property notices contained in the Resources.

All Resources are provided as general tools and are not a substitute for professional advice specific to your business circumstances.

9. Community Forum and User Content

Beauty Hub includes access to a private community forum. When you contribute content to the community (including posts, comments, or questions), you:

  • Retain ownership of your content;
  • Grant us a non-exclusive, royalty-free licence to display and moderate your content within the platform; and
  • Agree to conduct yourself respectfully and professionally at all times.

We reserve the right to remove any content that is offensive, defamatory, unlawful, or inconsistent with the spirit of the Beauty Hub community, and to suspend or terminate access for users who breach these standards.

10. Brand Partner Perks

Beauty Hub members may receive access to exclusive offers, discounts, and perks from our brand partners (including, but not limited to, Vida Glow, Synergie Skin, DMK, Dr. Spiller, and Timely). These perks are:

  • Subject to the individual terms and conditions of each brand partner;
  • Not guaranteed in perpetuity, as partner arrangements may change; and
  • Non-transferable and available to active members only.

The Foundry is not responsible for any products, services, or representations made by brand partners.

11. Intellectual Property

All content on the-foundry.com.au and within the Beauty Hub platform — including logos, brand assets, written content, templates, course materials, and workshop recordings — is the intellectual property of Foundry Partners Pty Ltd or its licensors.

You may not copy, reproduce, distribute, or create derivative works from our content without our prior written consent, except as expressly permitted under these Terms.

12. Results and Disclaimers

While we are proud of the results our partners have achieved (including an average of 25% revenue growth within 100 days), all outcomes depend on individual business circumstances, implementation, and market conditions. Nothing in our marketing materials or services constitutes a guarantee of specific results.

Our services are business support services and do not constitute legal, financial, medical, or professional regulated advice. You should seek independent professional advice where appropriate.

13. Limitation of Liability

To the maximum extent permitted by Australian consumer law:

  • We are not liable for any indirect, incidental, consequential, or special loss or damage arising out of or in connection with your use of our services;
  • Our total liability to you for any claim is limited to the fees you paid to us in the three (3) months preceding the event giving rise to the claim.

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law that cannot be excluded or limited by agreement.

14. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. If our services are not provided with due care and skill, or are not fit for the purpose for which they were supplied, you may be entitled to a remedy under the Australian Consumer Law.

15. Privacy

Your privacy matters to us. Our Privacy Policy, available at the-foundry.com.au/policies/privacy-policy, explains how we collect, use, store, and protect your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

By using our services, you agree to the collection and use of your information as described in our Privacy Policy.

16. Website Use

Your access to this website is provided on an "as is" basis. We do not warrant that the website will be uninterrupted, error-free, or free from viruses or harmful components. We reserve the right to modify, suspend, or discontinue any part of the website or our services at any time without notice.

17. Third-Party Links and Services

Our website and platform may contain links to third-party websites or integrations with third-party tools (such as Calendly, Timely, or payment processors). These third-party services are governed by their own terms and privacy policies. We are not responsible for the content or practices of any third-party services.

18. Modifications to These Terms

We may update these Terms from time to time to reflect changes in our services, legal obligations, or business practices. When we make material changes, we will notify active members via email or through the platform. Your continued use of our services after any changes take effect constitutes your acceptance of the updated Terms.
